Let me attempt in the most basic layman’s wording. Justice Odunga is the head of the Judicial Review division of the High Court. The work of this division is purely to supervise the govt, state/public organs and state officers to ensure they behave when making decision and they act in accordance with the laws of Kenya.
That means if James Orengo wanted to sue one of his ‘private’ clients or business associates the case would never find itself before Odunga. Or if any of the NASA principal were to sue his wife as a private affair they would never go before Odunga.
Is he the only judge in that bench? No.
Is he the only one who can hear NASA cases? On a day he is hearing one NASA case, he will be having about 15 or 20 other cases that will not be reported or transmitted live on TV. In fact Orengo may even be appearing as counsel in one of the 15 other “unreported” cases and even fail to get orders from the same judge. This is a complex web unless you know it well.
Judge Odunga has been criticized of favouring NASA in delivering justice.He is believed to be related to James Orengo.Jubilee now wants the judge to disqualify himself from hearing NASA cases.
