Chief Justice David Maraga can be sacked through this legal procedure.
~ Any Kenyan can file a Petition at the Judicial Service Commission (JSC) detailing reasons he/she wants a particular judge (Chief Justice in this case) investigated and, or sacked. The JSC may also act on its own motion if no Kenyan volunteers to file the petition.
~ The JSC shall write to the President okaying the grounds of the petition.
The President shall form a 7-member Tribunal within 14 days…..chaired by the Speaker of the National Assembly.
During this period, the President shall suspend the Chief Justice.
~ The Tribunal shall probe the Chief Justice within 14 days and report back their findings to the President.
~ The President shall act on those findings to either sack or reinstate the Chief Justice to his office.
