Before Kenyan police arrest you, they must do the following:
– Dignity is guaranteed. Personal dignity comes first and is guaranteed by the Constitution. The police should treat you with dignity.
– If the police want to arrest you, and you are not a fugitive, they should give you notice or ask you report to the police station.
– You have a right to an attorney paid for by the government if you cannot afford one.
– The police need to identify themselves before they touch you.
– The police need to show you arrest warrants and/or search warrants.
– The police need to seek your permission before they step into you abode.
– Under no circumstance should the police intimidate you. If they do.
If the police fail to do any of the above, you can file an application to have the case thrown out on a technicality, and you will be a free person.
