City Lawyer Adrian Kamotho has sued Safaricom, Telkom and Airtel for data bundle expiry.
The lawyer officially launched a complaint this week following outcry from the telecommunication companies’ customers. He claims that the telecom companies should not deprive their customers of their data bundles, arguing that since the customer has paid for it, they should be allowed to fully exhaust the bundles without the expiry option.
“Data bundles should not have an expiry date until used up‚ as long as the SIM card is active and the consumer keeps recharging,” he said.
Currently, each telecom company has specific expiry date for data bundles regardless of the bundle package such that even if the customer has not exhausted the bundles, they won’t be allowed to use them after the expiry date. Upon expiry of the data bundles, Safaricom, Airtel and Telekom will recover the bundles and sell to other clients, thus making double profits.
Early in the year, Mr Kamotho wrote to the Communications Authority of Kenya (CA) demanding clarification over the same but the authority didn’t give a satisfactory answer. He went ahead to demand answers and action from Communications and Multimedia Appeals Tribunal. He is hoping that a positive action will be taken that will favour consumers.
