Supreme Court Judge Philip Tunoi may not escape this time around after the Judicial Service Commission (JSC) recommended that President Uhuru Kenyatta form a tribunal to investigate him.
The commission noted that there was interaction and frequent communication between Tunoi and an agent of a litigant in a matter that was pending before the Supreme Court, which amounts to gross misconduct and misbehaviour, sufficient to warrant the establishment of a tribunal to further investigate the matter.
President Uhuru Kenyatta is expected to suspend the judge and subsequently form a tribunal either today or over the weekend to investigate the judge.
Mr Tunoi is accused of receiving Sh200 million from Nairobi Governor Evans Kidero in a bid to rule in favour of the Governor In an election petition filed by Kabete Member of Parliament, Ferdinand Waititu.
