The late Senator Mutula Kilonzo’s family is involved in a wrangle over the billions he left. The family is said to be legally battling for his multibillion corporate empire. His children have filed a case at the Nairobi High Court from 9th March 2016 despite the fact that their father left a will.

Mutula Kilonzo who was found dead in April 2013 at his Maanzoni home in Machakos owned chunks of land in Nairobi, Mombasa and Machakos. He also had assets in several companies. According to the will that was drafted in 1987, Cyrose Nduku, Mutula’s second wife was named the executor of the empire alongside his late father Mr. Kilonzo Musembi. This therefore left Nduku as the only executor of the estate.

His children from his first marriage, Mutula Kilonzo Jr, Michael Musembi, Rose Wanza and Kethi Kilonzo are against this. They want Mutula Jr. to be named as a second executor of the will. According to Mutula Jr. It would be breach of the Companies Act to name just one executor if the will deals with moveable and immovable properties.

Makueni senator and his siblings want Nduku stopped from transferring, disposing or alienating shares of every private company in the estate. They claim that Nduku presented a false inventory. They also want properties left out of the inventory included in their step mother’s application prior to the court’s confirmation of the document signed by their father. This particular inventory does not show the value of the assets their father owed Kenya Revenue Authority which added up to Sh481 million in tax arrears. The tax law allows for the debt to be met out of the assets of the estate.  Mutula Jr. states that Nduku has not been clear on whether the debt can be paid and from which assets. He explains that if Nduku does not list all the assets and liabilities, some might be left in limbo.

Besides the land, the late senator estate includes motor vehicles, gold jewelry, stocks and shares in more than 30 companies and parliamentary dues and liabilities.

The next hearing of this case was listed for 21st February, 2017.
