Kanyari was given custody of his children but Sky Victor,his first born is not happy—she wanted to remain with her step father Tash.Court considered all the points given by Tash and Kanyari and determined that Kanyari should be given full custody of the children.
Below are the reasons why Kanyari was given the custody:
There was proof that Kanyari owns three homes in Nairobi and one of them is close to school where the children go. Tash doesn’t own any home and he didn’t provide and evidence that he has one, he lives with the children in the house that belongs to their late mother.
Kanyari provided evidence that he pays school fees amounting to 1M per term at woodcreek international school, Tash did not provide any evidence that he pays any school fees but provided an Admission letter.
Kanyari provided evidence that he was also responsible for hospital bills for his children.
Tash only provided only photos to show the court that he married the children’s mother traditionally, no other evidence was provided
Tash provided photos of children going to vacation in Dubai and UK, Kanyari provided evidence that he was paying for those trips.
Tash said he’s a business man and works in USA but failed to provide evidence on what kind of business m/work he does, failed to disclose how he gets his money
There was no evidence brought to court to show that Kanyari is not fit to take care of his children, no evidence to show that he drinks.
Tash claimed that Kanyari is a busy politician and therefore will not be available ti take care of the children, Kanyari said that politicians have children that they take care of successfully.
Tash was demanding to be paid 1M Dollar by Kanyari, (sikuelewa ni za nini anataka alipwe)
Tash calls Betty’s house a crime scene, and it’s a rental house, that’s why he doesn’t allow people to visit there (sikuelewa poa, watch video to understand better, maybe I misunderstood)
Court did not dispute that Tash has lived with those children and they have a good relationship.
Court ruled in favor of Kanyari to have and take care of his children.
