  • How To Start a Research Company in Kenya

     

    Starting a research company is one of the simplest businesses to launch in Kenya. It involves less than 6 simple steps.

    1. Identify a unique name for your company

    Name identification is the first and most important process when registering your company. When doing this process, ensure you have a unique name which no other company shares with you.

    The name should also be different from your personal identification name, if you intend to make a powerful brand.

    1. 2. Conduct a name search at Huduma Centre offices to determine whether there is somebody sharing the same name with you. Name search takes at most 2 hours, thereafter you are allowed to do name reservation, which is done at Huduma Centre offices.

    If you are doing the process in Nairobi, visit Posta offices at Technical University of Kenya or GPO.

    1. Register your company

    After conducting name search and name reservation, you can go ahead and register your company at Huduma Centre offices. You can decide to register a sole proprietorship, a partnership or a limited company but I would advise you to register a partnership.

    Partnership business requires a partnership deed, which is simple to draft.

    The whole process of registering a partnership company will take you less than Ksh 2,000.

    One advantage of a partnership research firm is that you are able to obtain a KRA pin for your business, which is essential for applying for tenders.

    The business of starting a research firm ends with setting up an office.

    If you are in Nairobi, the rent for an office is Ksh 25,000-Ksh 50,000 depending on location. If you are in Nairobi CBD, the best and cheapest office rooms are found along Utalii Lane, Biashara Street and Moi Avenue

    A research firm business is tricky; you might find it hard to find clients but I would advise you to start with analyzing data for university students as you gain ground. You can also start teaching statistical tools and Microsoft office tools.

    The most important thing to do after finding an office is to get a license from your county council. In Nairobi, it will cost you Ksh 15,000-Ksh 25,000 and is acquired from City Hall

    From experience, the whole process of starting a research firm in Kenya is Ksh 150,000-Ksh250,000.If we break this figure further, you are required to acquire office furniture that cost Ksh 15,000-Ksh27,000 each while a chair will cost you Ksh 5,000-Ksh 15,000.Three month’s rent is required which will amount to Ksh 60,000-Ksh150,000.

     

  • Application for diplomatic Passport,Renew Passport in Kenya

     

    The process of applying for diplomatic passports and to renew a lost passport is explained below

    (D) Application for Diplomatic passports

    The applicant shall submit in addition to the requirements of ordinary passport a letter from the chief of protocol from the Ministry of foreign Affairs.

    (E) Disqualification of application for passports

    A Passport Control Officer shall disqualify the application of any person:-
    • Who is not a citizen of Kenya
    • Who gives false information for the purpose of obtaining a passport
    • Submits incomplete forms
    • In respect of whom there is evidence of involvement in passport fraud, passport forgery or international crime(s).

    (F) Revocation of Passports

    The Passport Control Officer may, where:-
    • The holder of a passport or travel document permits another person to use his passport or travel document
    • The holder of a passport has been deported or repatriated to Kenya at the expense of the government
    • The holder engages in drug trafficking, money laundering, human trafficking, terrorist acts or any other illegal activity
    • It is in national interest or national security
    • It is discovered that a Kenyan over 21 years of age is a holder of a passport of another country
    • The holder has a pending warrant of arrest, and
    • The holder is a habitual criminal;
    at any time withdraw, cancel or revoke the passport or travel document granted or issued to the holder.

    Passport Requirements

    1. New Passport

    All applicants must fill the application forms Form 19
    1. Be a Kenyan Citizen
    2. Duly completed Passport application form Form 19
    3. Applicant’s Birth, Adoption or Registration (original and photocopy) Certificate In some instances an applicant’s parent(s) birth certificate maybe required
    4. New generation National Identity Card (original and copy)
    5. Three coloured Passport size photographs of the applicant with one of photos duly certified as true likeness of the applicant by the recommender 6. Certified copy of the recommender’s National Identity Card

    3. Replacement of Mutilated Passport

    3. An affidavit detailing the circumstances under which the mutilation occurred

    4. Replacement of Lost Passport

    5. Diplomatic Passport

    2. Letter showing that the person meets the criteria set out in the third schedule of the Kenya Citizenship and Immigration Regulations, 2012 Legal Notice No.64. 3. Old Passport or original Birth Certificate and National Identity Card together with their respective photocopies
    4. Certified copy of the recommender’s National Identity Card
    5. Three coloured Passport size photographs of the applicant with one of photos duly certified as true likeness of the applicant by the recommender

    6. Temporary Permit

    1. Duly completed Temporary Permit application form

    PUBLIC NOTICE

    We wish to further advice that Kenyan citizens who wish to travel to countries in the Far East e.g. Singapore, Thailand, Indonesia, or to countries in the Middle East e.g. United Arab Emirates (U.A.E) should ensure that they hold the new generation Passports (i.e. their passports should have been issued from March 2008 onwards).

  • How to apply for a New Kenyan passport or replace an old or lost passport

     

    A passport allows you to travel outside Kenya or get important documents. You can apply for a new passport or replace one by following the following process.

    Application for passports in Nairobi is done at the Immigration Department at Nyayo House.

    KENYAN PASSPORT:

    Application Procedure

    A Kenyan who intends to acquire or to travel outside Kenya shall submit an application for a passport in person to the Passport Control Officer in a manner as may be prescribed. Applications can be submitted at the Nairobi, Mombasa and Kisumu Passport Control Offices.
    (A) Application for ordinary/ East African Passport (First application)
    The applicant shall submit an application for the passport in person in the prescribed manner i.e. Form 19.

    An application shall be accompanied by:-
    • Documentary evidence of Kenyan citizenship i.e. Original & copies of birth Certificate and National Identity Card, or a Certificate of naturalization or registration and Renunciation Certificate of former citizenship. • Current clear and un-mounted three passport size photographs as may be directed by the Passport Control Officer.
    • The Application must be recommended in section ‘7’ by a citizen of Kenya such as Minister of religion, a Minister or Legal Practitioner, an established Civil Servant or Bank Official personally acquainted with the applicant, but not by immediate relatives. The recommender must attach a copy of his/her National ID or passport.
    • In the case of an applicant who is below the age of eighteen years, the parents or legal guardian’s written consent.
    • In case of an applicant who is adopted, the original adoption certificate, clearance letter from the children’s department, and or, the Court ruling or award.
    • Prescribed fee.

    Note:

    The Passport Control Officer may require the applicant for a passport to produce supplementary information so as to ascertain the citizenship or nationality of the applicant. These may include the applicant’s parent’s birth certificate, national identity card, or certificate of naturalization or registration.

    (B) Application for Replacement of Passport

    The applicant shall submit an application for the passport in person in the prescribed manner or form.
    An application shall be accompanied by:
    • The previous passport and copy
    • Three (3) Recent clear passport size photographs (coloured)
    • In the case of a diplomatic passport, a letter from the Chief of protocol from the Ministry of Foreign Affairs
    • Prescribed fee

    Note:

    • The passport which was previously used and cannot be used any further shall immediately after the issuance of a new passport be cancelled by the Passport Control Officer.
    • No person shall be issued with a new passport unless the application is accompanied by the previous passport.

    (C) Application for Replacement of a lost or mutilated passport

    The applicant shall submit an application for the passport in person in the prescribed form.
    The application shall be accompanied by:-
    • An affidavit of the circumstances surrounding the loss, theft, mutilation or damage.
    • A police report on the loss of the passport
    • Prescribed fee

    Note:

    To ascertain the true circumstances on the loss, theft or damage of the passport, the applicant may be required to appear for an interview before a Passport Control Officer.

  • How to Get Student or employment pass in Kenya

     

    A pass allows you to enter Kenya and remain in Kenya for the purpose of receiving education or working in the country for a short duration. Student and employment passes are issued at the department of immigration

    STUDENT PASSES:

    This document issued to person(s) seeking to enter and remain in the country for the purpose of receiving education or training at an educational or training establishment within the country by which he/she has been accepted as a student/pupil.

    STUDENT PASSES REQUIREMENTS.

    1.Application form(form 8) dully filled signed and stamped
    2.Cover/forwarding letter from school stating the course and course duration
    3.Copy of the passport • biodata pages • visa page
    4.Two passport size photos
    5.Commitment letter from parent/legal guardian/sponsor
    6.6. The institution applying must be registered as an educational establishment. If the institution is relatively new a copy of registration must be submitted together with the application .

    DEPENDANT PASSES:

  • How To get Permanent Residency with children and spouses in Kenya

     

     

    Maybe you have been married by a Kenyan or you want to settle permanently in Kenya with your children and spouse, you need to go through a process in order to get permanent residency.

  • How to get a Work Permit in Kenya

     

    Work permit are issued to non Kenyans striving to work in Kenya. The process of getting the permit takes less than a week and involves simple steps.

    Work permits are issued by the Department of Immigration, which is located at Nyayo House next to GPO.

    You can either be issued with a pass or work permit.A pass is a document that allows you to enter and live in Kenya without much trouble while a work permit allows you to work for any company in Kenya without raising suspicion.

    PERMITS AND PASSES

    Permits.
    Work/Residence Permits are issued to any Non-Kenyan wishing to engage in employment in Kenya whether in gainful employment or voluntary service. The Work/Residence Permits issued by the Department are classified from A to M inclusive. They are issued under Kenya Citizenship and Immigration Act 2011 of Laws of Kenya. The following are the various classes of Permits and their respective requirements:

    Class A.
    Issued to persons who intend to engage in prospecting for minerals or mining.

    Class A Requirements.

    ◦One should obtain or is assured to obtain the necessary licenses and registrations.
    ◦For renewals current license held for prospecting minerals and copy of PIN is required.
    ◦One has sufficient capital or resources for investment.
    ◦Processing Fee Kshs.10,000 non-refundable.

    Class B.
    Work permit issued to persons wishing to invest in Agriculture and Animal Husbandry.

    Class B Requirements.
    ◦Proof of land ownership or leasehold interest in land for the purpose.
    ◦Proof of capital available for the purpose.
    ◦Clearance from relevant bodies.
    ◦For renewals current license held for prospecting minerals and copy of PIN is required.
    ◦Processing Fee Kshs.10,000 non-refundable.
    ◦Fee is Kshs. 100,000/= per year or part thereof.

    Class D.
    This issued to a person who is offered specific employment by a specific employer who is qualified to undertake that employment.

    Class D Requirements.

    •Copies of academic/professional certificates along with the CV.
    •Evidence that the organization failed to fill the vacancy from the local labor market.
    •Form 25 dully filled, signed and sealed by the company.
    •Processing Fee Kshs.10,000 non-refundable.
    •Fee is Ksh. 200,000/= per year or part thereof.

    Class G.
    Work permit issued to investors in specific trade, business or consultancy.

    Class G Requirements.

    ◦Documentary proof of capital to be invested/already invested minimum of 100,000 US dollars or equivalent in any other currency.
    ◦Registration certificate of the company OR certificate of incorporation.
    ◦Copies of personal and company PIN (Personal Identification Number) if business is running.
    ◦For renewals; audited accounts for previous 2 years and a certificate of tax compliance from the Kenya Revenue Authority.
    ◦Processing Fee Kshs.10,000 non-refundable.
    ◦Fee is Kshs. 100,000/= per year or part thereof.

    Class I.
    Work/Residence permit issued to a member of missionary society approved by the Government of Kenya and whose presence is beneficial to the country.

    Class I Requirements.

    ◦A copy of registration certificate of the organization.
    ◦Academic and professional certificates of the applicant.
    ◦Processing Fee Kshs.1,000 non-refundable.
    ◦Fee is Kshs. 5,000/= per year or part thereof.

    Class K.
    Residence permit issued to persons who have an assured income derived from sources outside and undertakes not to accept paid employment of any kind.

    Class K Requirements.

    ◦Documentary proof of assured income is required for Class K.
    ◦Processing Fee Kshs.10,000 non-refundable.
    ◦Fee is Kshs. 100,000/= per year or part thereof.

    Class M.
    Work permit issued to Conventional Refugees.

    Class M Requirements.

    ◦Recognition letters from UNHCR and Department of Refugee Affairs.

    GENERAL REQUIREMENTS.

    Nairobi Senator Miko Sonko has a word for you, especially if you have poor financial management skills. The flamboyant Senator says “it’s not what you earn that matters but what you save. See his inspiring advice:

    “Watu wangu You may know how to earn money. You may be in a job with a comfortable salary or own a business that can afford to pay you quite well. You may even be in a job that is financially related such as an investment adviser, accountant etc. It does not mean you know how to create wealth. Most people mistake earning a good salary or having the correct job title with being able to create wealth or worse still “being wealthy”. The two are worlds apart.

    How much can you keep of what you earn? James is earning Kshs 400,000 per month as a banker. His expenses inclusive of a home mortgage and car loans he is servicing come to Kshs 350,000 per month. He is able to save Kes 50,000 per month. Muthoni, who works as a farm manager earns Kshs 50,000 per month. Her expenses are Kshs 30,000. She is able to save Ksh 20,000 per month. It may look like James is saving more but in comparison to his lifestyle he is not. He is saving only 13% of his salary whilst Muthoni saves 40%.

    How fast you can grow it so that it can accumulate to something that can eventually support you? James is busy and has therefore opted to leave his money with a fund manager to place in Unit Trusts. Muthoni has decided to pool her Kshs 20,000 per month together in a Chama with 5 people. They therefore raise Kshs 100,000 per month. In three months they were able to get enough funds to lease some land and start growing tomatoes. After all expenses are paid including hiring of a manager, the project generates an income of Kshs 30,000 per month. They have decided for the next 5 years to keep retaining the money in the business, continue with their monthly contributions and acquire more land and continue growing tomatoes. With Muthoni’s expertise they expect to be earning on a conservative basis Kshs 250,000 per month by then. This means each person will be taking home Kshs 50,000 per month at that time.

    Every Kenyan whether employed, self-employed or in entrepreneurship must submit returns annualy. Failure to submit returns on time attracts stiff penalties and heavy fines

    The following are penalties charged if you fail to comply with KRA PAYE, Income, Rent and VAT taxes.

    All registered taxpayers are required by Law to adhere to the above-mentioned obligations but as a measure to enforce and enhance compliance, the VAT Act spells out certain offences and respective penalties.

    These include: –

    1. Failure to register – fine not exceeding Kshs.20, 000 or imprisonment for a term not exceeding six months or both
    2. Enforced registration – default penalty of Kshs. 100,000
    3. Failure to submit a return on or before the due date or submitting a payment return without paying the tax due – default penalty of Kshs.10, 000 or five percent of the tax due whichever is the higher and additional interest of 2% per month compounded.
    4. Failure to keep proper records – a default penalty of between Kshs.10, 000 to Kshs.200, 000

    5 Fraudulent Accounting – a fine not exceeding Kshs.400, 000 or double the tax evaded whichever is greater or imprisonment for a term not exceeding three (3) years or both.

    1. Failure to issue a Tax Invoice – an automatic penalty of not less than Kshs.10, 000 but not exceeding Kshs.100,000/=.
    2. Hindrance or obstruction of authorised officers
    3. Uttering false statements
    4. Charging tax when not registered – tax shown on such invoice is due to the Commissioner within seven (7) days.
    5. Failure to display a certificate of registration – a default penalty of Kshs.20, 000 and a fine not exceeding Kshs.200, 000 or imprisonment for a term not exceeding two (2) years or both.
    6. Failure to comply with VAT regulations
    7. Failure to pay tax and late payment

    Note:

    For offences, which no specific penalty is provided, a general penalty of a fine not is exceeding Kshs.500, 000 or imprisonment for a term not exceeding three (3) years or to both is applicable.
